Except as provided in Subsection (b) below, the provisions of Planning Code Sections 163, 164 and 165 shall apply in MB-O and MB-CI Districts with regard to any new building, addition or conversion where the added floor area of office use equals at least 100,000 of gross square feet.
Sections 163, 164, and 165 shall not apply to any new building, addition or conversion for which a building permit is issued while the Mission Bay Development Agreement, as defined in Section 996(b)(5), is in effect, except to the extent contemplated in the Development Agreement and its related documents.
